Warranty terms

These Terms describe the warranty conditions applicable to IT and electronic equipment products sold by Abian Marketplace SIA: the warranty period, what the warranty covers and does not cover, how to submit a warranty claim, and how servicing is carried out.

1. General provisions

1.1. Products sold by Abian Marketplace SIA are covered by the warranty specified by the manufacturer. These Terms apply to all brands of IT and electronic equipment products included in our product range.

1.2. The manufacturer’s warranty is an additional benefit provided by the equipment manufacturer. It does not limit the statutory liability of Abian Marketplace SIA, as the seller, for the Product’s conformity with the contractual terms to the extent that such liability may not be limited in transactions between persons carrying on economic activity.

2. Warranty period

2.1. The warranty period is stated in the Product’s delivery note, invoice or manufacturer’s warranty document and varies depending on the manufacturer, the type of equipment and the purchaser’s status.

2.2. The warranty period is generally 12–36 months, based on the warranty period provided by the relevant manufacturer for the particular model.

2.3. The warranty period is calculated from the date on which the invoice is issued, unless otherwise specified in the manufacturer’s documentation.

2.4. The precise warranty period is stated on the delivery note or invoice, or in the manufacturer’s warranty card.

3. Product defective upon receipt (DOA)

3.1. If the equipment does not operate when first put into use, the Customer must notify Abian Marketplace SIA within 14 calendar days of the delivery date.

3.2. If DOA status is confirmed and the manufacturer’s or distributor’s procedure permits it, Abian Marketplace SIA will arrange replacement of the Product or the issue of a credit note/refund. If DOA status is not confirmed, the matter will be considered in accordance with the applicable warranty procedure or the procedure governing the seller’s liability.

3.3. The claim must specify the invoice number, Product name, serial number and a description of the defect, and must be accompanied by photographs. The equipment must not be dispatched without prior agreement.

3.4. Once the 14-calendar-day period has expired, the matter will be handled as an ordinary warranty claim in accordance with Section 6.

4. What the warranty covers

4.1. The manufacturer’s warranty covers hardware defects arising during the warranty period as a result of defects in manufacture or materials. Depending on the circumstances, the equipment will be repaired or replaced.

5. What the warranty does not cover

5.1. The warranty does not apply where:

  • the damage has resulted from improper use, negligence or an accident;
  • liquid has entered the equipment, or the equipment has overheated, and this is not attributable to a manufacturing defect;
  • the damage has resulted from normal wear and tear (for example, fans and moving parts);
  • software problems or data loss have been identified;
  • the equipment has been opened, repaired or modified by an unauthorised service centre;
  • warranty seals or serial-number labels have been damaged or removed;
  • the Product has not been used in accordance with the manufacturer’s instructions for use.

5.2. Causal connection. The exclusions set out in this Section apply only to the extent that the relevant act, circumstance or wear and tear is causally connected with the defect claimed. The condition of a seal or label, the opening of the equipment or an inaccuracy in documentation which is unrelated to the defect claimed does not, in itself, exclude the warranty in its entirety.

5.3. Battery. A natural reduction in battery capacity during use is not regarded as a defect. The battery is subject to the separate warranty and capacity threshold specified by the manufacturer, which may differ from the equipment’s principal warranty period.

5.4. Pixel defects. Display pixel defects are assessed in accordance with the applicable manufacturer’s standard governing permissible pixel defects.

6. Warranty service procedure

6.1. In the event of a warranty claim, the Customer has two options:

  • Directly through the manufacturer’s authorised service centre — this is the quickest option, as the service centre decides whether the warranty applies and no intermediate steps are involved.
  • Through Abian Marketplace SIA — an additional option whereby a claim is submitted through the Marketplace system. Abian forwards the claim and monitors its progress.

6.2. Abian’s involvement as an intermediary does not alter the manufacturer’s warranty conditions, time limits or assessment criteria.

6.3. If the manufacturer’s authorised service centre rejects a warranty claim, Abian Marketplace SIA will not overturn that decision within the framework of the manufacturer’s warranty — the decision on the application of the manufacturer’s warranty is taken by the manufacturer and its authorised service centre. This does not affect the Customer’s rights under applicable legislation concerning the seller’s liability for defects in the Product that existed at the time of sale (see Clause 1.2).

6.4. The principal authorised service providers in Latvia include:

  • TSC (tsc.lv) — an authorised service centre holding authorisations from Apple, Samsung, Huawei, Sony, Xiaomi and other manufacturers, located in Riga (RÄ“zeknes iela 5a and Blaumaņa iela 5a-1F).
  • Servicenet.lv — an authorised ASUS and HP service provider, MÅ«kusalas iela 41, Riga.
  • Servisa ICT — an authorised service provider for ASUS laptops, MÅ«kusalas iela 15a, Riga.

6.5. Customers are also advised to consult the relevant manufacturer’s official website for the current list of authorised service centres, as that list may change.

7. Types of warranty service

7.1. Carry-in. The Customer takes or sends the equipment to an authorised service centre and receives it back following repair. This is the standard type of warranty service for most laptops, monitors, peripherals and consumer electronics.

7.2. On-site. A service technician attends the location of the equipment and carries out the repair there. This type of service generally applies to servers, workstations, network equipment and models for which the manufacturer has provided the relevant service level.

7.3. The type of service applicable to a particular Product is determined by the manufacturer’s warranty conditions for the relevant model and is stated in the manufacturer’s warranty documentation.

8. Repair periods and replacement equipment

8.1. Repair periods are determined by the manufacturer and the authorised service centre in accordance with their respective terms. Abian Marketplace SIA neither controls nor guarantees those periods.

8.2. Abian Marketplace SIA does not provide replacement equipment for the duration of a repair.

8.3. The original unexpired warranty period will continue to apply to replaced or repaired equipment.

9. Transport costs

9.1. The parties will agree separately in each case upon the transportation of the equipment to and from the authorised service centre and the associated costs, taking into account the circumstances of the case and the manufacturer’s conditions.

10. Required documentation

10.1. In order to exercise warranty rights, proof of purchase — a delivery note or invoice — must be presented.

10.2. No alterations may be made to the documents. If alterations have been made to a document which affect its reliability or the ability to prove the fact and date of purchase, Abian Marketplace SIA is entitled to reject the warranty claim.

10.3. Customers are also advised to retain the manufacturer’s warranty card and the original packaging.

11. Data and confidentiality during repair

11.1. Warranty service centres are not responsible for the preservation of data during repair.

11.2. Before submitting the equipment for repair, the Customer is advised to back up important data, delete confidential information, remove storage media where possible, and disable disk encryption or provide access to the decryption keys.

11.3. Abian Marketplace SIA is not responsible for data stored on equipment submitted for servicing.

12. Diagnostic charges

12.1. If the defect reported in equipment submitted for warranty repair is not confirmed, or if warranty coverage is refused, the service centre is entitled to charge for the diagnostic work carried out in accordance with the relevant manufacturer service centre’s price list.

13. Warranty in the event of resale

13.1. The manufacturer’s warranty generally follows the equipment and may also be exercised by an end user to whom the Customer has resold the Product.

13.2. Proof of purchase remains decisive for the exercise of warranty rights. The specific conditions are governed by the warranty terms of the relevant manufacturer.

14. Final disclaimer

14.1. Customers are advised to verify the precise warranty terms in the warranty card for the particular Product or on the relevant manufacturer’s official website, as they may vary according to the category and model of the equipment.

14.2. These Warranty Terms are subject to the Abian Marketplace Terms of Use. In the event of any conflict, the Terms of Use prevail.
