Shipping Policy

These Terms describe the arrangements for the delivery of Products ordered from Abian Marketplace SIA: costs and timeframes, the transfer of risk and title, the Customer’s obligations upon receipt of the Products, and the procedure applicable where the Products are not accepted.

1. Payment and dispatch

1.1. Unless otherwise agreed by the Parties in writing, the Customer shall pay for the order in advance using one of the payment methods available on the Platform: advance payment by bank transfer, bank payment or payment card. Products will be dispatched only after ABIAN Marketplace SIA has received payment for the order in full.

1.2. Credit limit. Products will be dispatched without advance payment, within the applicable credit limit, to Customers who have been granted an approved credit limit, and the invoice shall be payable within the period specified in the Terms of Use. If any payment by the Customer is overdue, the credit limit will be suspended automatically and further deliveries will be suspended until the debt has been discharged in full.

2. Delivery territory

2.1. Abian Marketplace SIA delivers within Latvia. Deliveries outside this territory shall be agreed separately before the order is confirmed.

2.2. Deliveries will not be made to countries or jurisdictions subject to sanctions, or where there are reasonable grounds to suspect the circumvention of sanctions or unauthorised re-export. Abian Marketplace SIA is entitled to reject or cancel such an order without incurring liability.

3. Delivery costs

3.1. Delivery and packaging costs are calculated and displayed during the ordering process before the purchase is completed.

3.2. Free delivery applies to orders of EUR 100 or more (excluding VAT), unless one of the special circumstances referred to in Clause 3.3 applies to the particular order.

3.3. Special circumstances. An additional charge may apply in certain circumstances — for example, in relation to oversized Products, remote delivery locations or unique handling requirements. In such cases, Abian Marketplace SIA reserves the right to contact the Customer to discuss the delivery arrangements and agree the revised costs before processing the order.

3.4. The Customer shall arrange unloading at the delivery location unless otherwise agreed. This applies in particular to Products delivered on pallets or in oversized packaging.

4. Delivery terms and transfer of risk

4.1. Unless otherwise stated in the Order Confirmation, delivery shall be made in accordance with the Incoterms® 2020 DAP (Delivered at Place) rule to the address specified by the Customer. Where transport is arranged by the Customer, the EXW rule shall apply.

4.2. The risk of accidental loss of or damage to the Products shall pass to the Customer at the time specified in the applicable Incoterms rule: in the case of DAP, when the Products are placed at the Customer’s disposal at the specified destination; in the case of EXW, when the Products are handed over to the Customer or its carrier.

4.3. Customs duties, taxes and import formalities shall be borne and handled by the Party designated under the applicable Incoterms rule. Where the Products are exported outside the European Union, the Customer shall be the importer in the country of destination unless otherwise agreed.

5. Delivery timeframes

5.1. Approximate delivery timeframes are displayed when browsing Products in the Catalogue.

5.2. A specific delivery estimate is provided during the order review process.

5.3. The estimated delivery date is stated in the Order Confirmation email.

5.4. All stated timeframes, including the date stated in the Order Confirmation, are estimated and indicative. They do not constitute a binding delivery deadline unless the Parties have separately agreed a fixed deadline in writing.

6. Fulfilment, partial deliveries and tracking

6.1. Products are delivered door to door directly from distributors’ warehouses. Deliveries are carried out in cooperation with professional third-party courier services or other specialised logistics service providers.

6.2. Partial deliveries. As Products are dispatched from several distributors’ warehouses, Abian Marketplace SIA is entitled to make partial deliveries and issue separate invoices for them. A partial delivery shall not constitute improper performance of the order.

6.3. Once the Products have been dispatched, the Customer will receive a notification stating the carrier’s name and the tracking number. The order status and history are also available in the Customer dashboard.

6.4. Change of delivery address. The address may be changed until the Products are handed over to the carrier. After dispatch, the address may be changed only where the carrier permits this, and the Customer shall bear the associated costs.

7. Inspection of Products upon delivery

7.1. The Customer is obliged to inspect the Products, their quantity and their packaging upon receipt.

7.2. Any visible damage, breach of packaging or discrepancy in quantity must be recorded immediately on the transport consignment note, and photographic evidence must be taken and sent to Abian Marketplace SIA on the same day.

7.3. The Customer must give written notice of any damage sustained during transport which was not visible at the time of delivery within seven calendar days of the delivery date. Any defects in the Product which are unrelated to transport must be reported immediately upon discovery.

7.4. These time limits arise from the conditions of carriage and are necessary to preserve rights of recourse against the carrier. If the Customer fails to comply with them or with the requirement in Clause 7.2 to make a record and take photographic evidence, the Customer shall bear that part of the loss which Abian Marketplace SIA is consequently unable to recover from the carrier.

8. Failure to accept the Products

8.1. The carrier will make no more than three delivery attempts. If the Products are not accepted, they will be returned to the sender or delivered to the physical address specified by Abian Marketplace SIA.

8.2. If the Customer fails to accept the Products at the agreed time or fails to make delivery possible, risk shall pass to the Customer from the date on which the Products were available for delivery.

8.3. The Customer shall bear the cost of repeated delivery.

8.4. Abian Marketplace SIA is entitled to store the Products at the Customer’s expense and charge a storage fee of 0.5% of the value of the relevant Products for each commenced week of storage, subject to a minimum of EUR 25 per week.

8.5. If the Products are not accepted within 30 calendar days, Abian Marketplace SIA is entitled to withdraw from the order and claim damages.

9. Title to the Products

9.1. Title to the Products shall pass to the Customer once the invoice has been paid in full. Until payment has been made in full, the Products shall remain the property of Abian Marketplace SIA.

9.2. Until title passes, the Customer is obliged to store the unpaid Products in an identifiable manner, insure them, refrain from pledging them, and notify Abian Marketplace SIA immediately of any third-party claims or insolvency proceedings. 10. Final provisions

10.1. These Delivery Terms are subject to the Abian Marketplace Terms of Use. In the event of any conflict, the Terms of Use shall prevail.
